A summary of the legal biography of Robert B. Gerard, the principal attorney on this case is set forth below:

i). Robert B. Gerard is a 1980 graduate of the University of San Diego School of Law and a 1977 graduate (B.A.) from State University of New York at Stoney Brook.

ii). Robert B. Gerard has been engaged in the active practice of law since 1980, and is licensed to practice before Courts of the State of California and State of Nevada, as well as the Federal District Courts for the Southern District of California, District of Nevada, and the United States Court of Appeals for the Third Circuit.

iii). From 1983 to present, Robert B. Gerard has maintained a practice emphasis in the representation of Plaintiffs in consumer law. During that time, he has represented consumers in a large number of complex matters and class action litigation. Significant cases include: Williams v. Shell and Cioe v. Shell (1992), certified class actions involving 50,000 properties that were built with a plastic plumbing system called polybuthelane (P.B.); Louisiana Pacific Exterior Siding litigation; G.M. Side Saddle Gas Tank litigation; Elan v. Picerne (584 condominium construction defect case), San Diego County Tobacco litigation (County to receive approximately one billion dollar recovery).

iv). In 1995 Robert Gerard participated in the drafting and lobbying efforts that resulted in the first consumer construction defect statute (N.R.S. 40.600) in the State of Nevada. This law provided an effective procedure for the citizens of the State to obtain relief for damages and repairs to their homes resulting from faulty construction.

v). Mr. Gerard has authored numerous articles and seminar materials on consumer law associated with his role as the Chair of the State Bar of Nevada Construction Defect Seminar in 1999 and 2000, as well as numerous seminars hosted by Lorman Business Center on construction law and litigation practices.

JEREMIAH PENDLETON, ESQ.

Mr. Pendleton is long-time resident of Las Vegas, Nevada. After obtaining his B.A. in psychology at the University of the Nevada, Las Vegas, Mr. Pendleton attended California Western School of Law in San Diego, California. He joined the law firm of Gerard & Associates in 2003. Since that time, Mr. Pendleton has been involved in each of the firm's practice areas, including complex construction defect and class action litigation.

Mr. Pendleton is admitted to the Nevada State Bar, as well as the United States District Court, District of Nevada. In addition, he is a member of the Clark County Bar Association, the Nevada Trial Lawyers Association and the American Bar Association.
